HELLER AFFIRMED!!! The 2nd Amendment guarantees an Individual's right to bear arms

Today is a historic day. This morning, the Supreme Court ruled on the case of District of Columbia v. Heller. The case was brought to challenge the D.C. ban on handguns and their super restrictive rules on firearms in general, even preventing people from keeping firearms in their own homes for protection.

This is monumental because this is the first time that the Supreme Court has ruled on the 2nd Amendment broadly. There was a previous case in 1939, but even then, the SCOTUS ruled only on the specifics of that case while avoiding the bigger argument regarding actual interpretation of the 2nd Amendment.

The Amendment states: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

This has been widely interpreted over the years, since it's passage in 1791, but has not been ruled on by the Supremes. Today is historic for two reasons.

First, by the affirmation of Heller, the SCOTUS is saying that the 2nd Amendment guarantees an INDIVIDUAL's right to keep and bear arms, NOT a state militia only.

This means that many senseless gun laws across the country can be challenged now on real constitutional grounds. From the Syllabus of the ruling:

"The Second Amendment protects an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditional lawful purposes, such as self-defense within the home."

The second reason this is so historical is that this ruling is one of the VERY rare occurrences where a Supreme Court has the opportunity to rule and interpret an amendment with virtually NO precedent. Most constitutional rulings are at least in part based on previous rulings. In the Heller case, since there have been no judicial reviews of the 2nd Amendment in the last 200 years, there was nothing to go on. Thus, this Supreme Court had the honor of being the first to rule specifically on the amendment, creating the precedent, instead of following the precedent.

This case has had me on edge for months. A ruling in favor of D.C. could have meant a slew of poorly crafted and ill advised anti-gun laws across the country. In a nation built on individual freedom, ruling against Heller could have stripped us all of one of the most basic of American rights. In ruling for Heller and affirming the individual's right to bear arms today, the Supreme Court has settled one of the most hotly debated questions in the last 100 years.

I am ecstatic! I can not begin to tell you how happy I am today. I plan on going out and buying some ammo for my handguns, and maybe doing a little target shooting today, or this weekend. The Heller decision is exactly as I had hoped and wished for it to turn out, and shooters and believers in personal self-defense can rest a little easier tonight.

Now my next hope is that this can lead to a real Castle Doctrine in North Carolina...
