Today is a historic day. This morning, the Supreme Court ruled on the case of District of Columbia v. Heller. The case was brought to challenge the D.C. ban on handguns and their super restrictive rules on firearms in general, even preventing people from keeping firearms in their own homes for protection.

This is monumental because this is the first time that the Supreme Court has ruled on the 2nd Amendment broadly. There was a previous case in 1939, but even then, the SCOTUS ruled only on the specifics of that case while avoiding the bigger argument regarding actual interpretation of the 2nd Amendment.

The Amendment states: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."  read more »

Holy crap! Olbermann is fired up more than I have ever seen before. I'd vote for this guy...

Heading into the Thanksgiving holiday, I thought I would provide this little bit of humor... one of the better political ads I have seen in ages. I am not normally one to really become overly political (beyond my support for Georgy in California) but this is just too damn funny. I am glad to see a politician with the balls to be just a bit irreverent during this run up to the Presidential elections next year.

ESPN has an update on the story about the High School senior who got 10 years in prison for getting a blow job. The article is very well written and honestly, this idiocy in Georgia makes my blood boil.

For history, the kid was a 17 year old senior in high school. He was a football player AND had a reported 3.2GPA. He was being recruited by a lot of schools and would have had a chance to make a good life for himself. His only mistake was getting oral sex from a 15 year old girl at a New Years party.

The sad part of this story is that if he had had full on sex with the 15 year old girl, he would have only been charged with a misdemeanor offense, gotten off and gone on with his life. However, since he had ORAL sex, he got charged with a felony.  read more »

ATLANTA (AP) — The Georgia Supreme Court has turned down an appeal from a teen who was sentenced to 10 years in prison for having sex with a 15-year-old.
In a ruling released Friday, the court denied a motion for reconsideration filed by lawyers for Genarlow Wilson, who was 17 when he and the 15-year-old engaged in consensual oral sex. He was sentenced for aggravated child molestation.  read more »

CNN is carrying a story about the results of the NSA Warrentless Wiretapping program started by Pres. Bush.

The Federal District Judge in the case has ruled that the program IS UNCONSTITUTIONAL!!!!

YES!!! Lets hear it for some common sense and protecting the Constitution of the United States!

I know this isn't a herald for some sweeping change and return to the days before the Federal Government started trampling our civil and constitutional rights without regard for anything, but still, it's a very important first step.  read more »

Just wanted to share an excellent essay on the erosion of our constitutional rights under the current administration. I am not a Republican. Nor am I a democrat. I am not a liberar, and I am not a conservative. I am a Libertarian, and my own personal beliefs fall somewhere just to the left or right of moderate, depending on the topic of discussion.

But beyond that, I am a firm believer in the Constitution of the United States and the freedoms, protections and responsibilities it represents, affords and creates. What the modern Republicans AND Democrats are doing both to our country AND our Constitution is disgusting, deplorable and fills me with the urge to defacate.  read more »

Hayden is the second chair of the NSA. He has NO FREAKING CLUE what the 4th amendment is all about. To quote him: "If there is one amendment that we at the NSA know intimately, its the 4th" and then he goes on to misquote it, and even argue that "Probable Cause" is nowhere in the 4th amendment.

Oh, and for those 80% of you in the U.S. who dont know your constitutional history, the Fourth Amendment is the one that protects you from unreasonable search and seizure, requireing a warrant to search that includes Probable Cause.  read more »

Choking on a Ham sandwich... well, at least we can hope. It is amazing that Michael Moore, the loud mouthed ass has been so quiet. He stormed around Florida and Ohio with his army of volunteer cameramen just certain to find hours of film showing voter fraud, abuse, etc... but he found none. The Miami Herald says he simply packed his bags and left quietly for Ohio when he realized that there was nothing for him there. He presumably did the same thing on arriving in Ohio, since he did not make any noise what so ever.  read more »

Nothing in life seems to be as tiring as kids. This weekend I came to my home town to visit my best friend, his wife, and their three kids.

I am still recovering.

It's not as bad as it seems, however. They are three lovely kids. Hailey is a wonderful, lovely little gal, who doesn't listen at all... Natalie is a little ball of fire, who never seems to tire out, even when she is tired. Mason is the youngest of the three, and he is going to be one big ol' boy. Hell, he may even whoop my ass when he gets older, just because he will probably get tired of my BS. :)  read more »
